Current issues and trends at the permission stage: Case law and statistics.
The permission stage has now been part of Court of Session judicial review procedure for over three years. Lesley will discuss some of the current issues arising at the permission stage under reference to recent case law, in particular AP & Others v Lord Advocate  CSOH 23, and the results of a recent Freedom of Information request for permission stage statistics, from which she will seek to identify the current trends in decisions on permission and draw some conclusions about the way in which the process is being and can be engaged with successfully, on either side.

Judicial Review – the growing pains of the (not so) new procedures.
The (not so) new procedures in Judicial Review have given rise to new problems: how to apply time-bar and when to extend it, is there a right to a hearing on permission and when is it appropriate to deal with Eba? The answers to these problems are being worked out, pragmatically and daily, by the Court. But these solutions are not always visible through reported decisions. What are these problems and what are the solutions? Dan will try to grasp the thicket of nettles.
