Professional liability of advisors following the failure of tax schemes.

Challenges to tax avoidance schemes by HMRC are now commonplace and have resulted in some high-profile court proceedings. The wider consequence of a victory for HMRC is often a raft of litigation by customers of the failed schemes against those professionals on whose advice they relied. David will consider some of the decisions in this topical area and what can be taken from them.

Causation – the subject they don’t really teach you at university.

The issue of causation is vital in professional negligence cases, but it often receives surprisingly little detailed analysis, either from academics or judges. Is it enough to say it’s all a matter of common sense? Garry will consider this topic under reference to some recent professional negligence cases.

Kenny McBrearty, QC

Res inter alios acta and black holes.

Kenny will consider the issue of when collateral benefits are to be left out of account in assessing loss, together with the principle of transferable loss. In particular, he will consider the recent Supreme Court decision in Swynson Ltd v Lowick Rose llp and what can be taken from it.
