The Validity of notices issued under building contracts is critical in being able to win battles and wars in construction cases. Scott will consider some recent cases turning on the proper construction of these important documents.

Prescription in the context of construction claims
Adam will present an update on this ever-topical issue. He will focus in particular on the situation where one party, often the main contractor, seeks to recover loss in the form of liability which has been incurred to another party, often the employer, due to breach of contract by a sub-contractor. He will also consider the Prescription (Scotland) Bill and its likely impact on construction disputes once the proposed reforms are enacted.

Resisting adjudicators' awards: Do you feel lucky?
Jonathan will consider what steps might be taken in an attempt to resist enforcement of an adjudicator's award.
