The case related to two projects to extract methane gas from Lake Kivu in Rwanda, for the purposes of which the Government of Rwanda entered into contracts with the pursuers and the defenders respectfully.
Axiom’s Richard Keen QC and Almira Delibegovic-Broome successfully opposed the pursuers’ attempt to overturn the decision of Lord Drummond Young, recalling an ex parte interim interdict. The interdict sought to stop the respondents from conveying certain information about their contract and dispute with the Government of Rwanda. The Second Division noted, among other things, that the terms of the interim interdict granted ex parte were too wide, in seeking to apply to any representations of the kinds described, no matter to whom they were made, and without any limit of time.
